Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ACTIQO website and services. ACTIQO ("ACTIQO", "we", "our", or "us") is operated by FindYourVine LLC, a Michigan-based company. By using ACTIQO, you agree to these Terms.

1. Use of the Service

ACTIQO provides software tools designed to help families evaluate activities and gain insights about time, energy, and resource allocation. You agree to use the service only for lawful purposes.

You may not:

• Attempt to reverse engineer the service
• Interfere with service operations
• Access accounts that are not yours
• Use the platform for illegal activities

2. Accounts

Some features may require creating an account. You agree to provide accurate information, maintain confidentiality of your login credentials, and notify us of unauthorized use. You are responsible for all activity under your account.

3. Subscription and Billing

ACTIQO is currently offering Early Access. Accounts created through Early Access are granted complimentary access to the Family experience: no payment is required to obtain or maintain Early Access, and no payment method is collected as a condition of Early Access. Early Access is not a subscription and is not a trial of a subscription. The subscription and billing terms below govern any paid subscription a user holds or later purchases, and remain in effect for existing subscriptions.

ACTIQO may offer eligible new users a trial of the Family Plan. New users may receive a 7-day trial without providing a payment method or a 30-day trial when a valid payment method is provided. For trials requiring a payment method, the applicable subscription charge begins after the trial period unless the subscription is canceled before the trial ends. Apple-managed subscriptions may be canceled through the user's App Store subscription settings. Other subscriptions may be managed through ACTIQO where available. Users who do not maintain a paid subscription may continue using features included in the Free plan. Prices and renewal terms are displayed before purchase.

4. Data Ownership

You retain ownership of information you submit to ACTIQO. By using the service, you grant ACTIQO a limited license to process and analyze your data to provide insights and improve the platform. We may use anonymized or aggregated data to improve our services. You may request deletion of your data at any time via our Privacy Policy.

5. Intellectual Property

All ACTIQO software, content, and technology are the property of FindYourVine LLC (d/b/a ACTIQO) and are protected by intellectual property laws. You may not reproduce, copy, distribute, or create derivative works without permission.

6. Service Availability

We strive to maintain reliable service but cannot guarantee uninterrupted access. ACTIQO may modify or discontinue features at any time.

7. Limitation of Liability

To the fullest extent permitted by law, ACTIQO shall not be liable for indirect damages, loss of profits, loss of data, or consequential damages arising from use of the service.

8. Disclaimer

ACTIQO provides informational insights based on user inputs. We do not guarantee specific outcomes. Users remain responsible for decisions regarding family activities or investments.

9. No Professional Advice

ACTIQO provides general informational insights based on user-submitted data. The platform does not provide medical, psychological, financial, or professional advice. Any decisions regarding children's activities, scheduling, or investments should be made at your own discretion and, where appropriate, in consultation with qualified professionals.

10. Termination

We may suspend or terminate accounts that violate these Terms. Users may also stop using the service at any time.

11. Governing Law

These Terms shall be governed by the laws of the State of Michigan.

12. Changes to Terms

We may update these Terms periodically. Continued use of the service after updates constitutes acceptance of the revised Terms.

13. SMS Messaging

If you choose to enable SMS notifications within the ACTIQO platform, you consent to receive occasional text messages related to activity check-ins, reminders, or service updates.

• Message frequency may vary depending on activity schedules and platform usage.
• You may opt out of SMS messages at any time by replying STOP to any message. For assistance, reply HELP.
• Standard message and data rates may apply depending on your mobile carrier.

14. Dispute Resolution

Any disputes arising from these Terms or use of ACTIQO shall be resolved through binding arbitration in the State of Michigan, unless otherwise required by law. Users waive the right to participate in class-action lawsuits.
